PoolStream Terms of Service

Effective Date: September 4, 2026

These Terms of Service ("Terms") govern the purchase and use of PoolStream hardware, software, websites, cloud services, and related services (collectively, the "Services"). By creating a PoolStream account, purchasing or activating a PoolStream device, or using the Services, you agree to these Terms.

1. PoolStream Services

PoolStream provides hardware and software designed to facilitate live streaming and management of billiards and pool matches. Depending on the features and subscription selected, PoolStream may provide video streaming integration, scorekeeping, match overlays, remote device management, venue and device administration, and other related functionality.

Certain features require third-party services, such as YouTube, Facebook, internet service providers, or other streaming platforms. PoolStream does not control those third-party services.

2. Accounts

You must provide accurate and current information when creating and maintaining a PoolStream account.

You are responsible for activity performed through your account and for maintaining the security of devices, email accounts, credentials, streaming keys, and other authentication methods associated with your account.

You must promptly notify PoolStream if you believe your account or a PoolStream device has been compromised.

PoolStream may suspend or disable accounts reasonably believed to be compromised, used unlawfully, or operated in violation of these Terms.

3. Hardware Purchases

PoolStream hardware may include a PoolStream appliance, camera, power supply, display, cables, mounting equipment, or other components.

Hardware charges are separate from recurring PoolStream service charges unless expressly stated otherwise at the time of purchase.

Ownership of purchased hardware does not by itself provide an indefinite right to paid PoolStream cloud services or subscription features.

Pricing, shipping charges, applicable taxes, warranty information, and any return policy will be disclosed during the applicable purchase process.

4. Subscription Services

Certain PoolStream functionality requires an active paid subscription.

Subscription pricing and the applicable billing period will be disclosed before purchase or activation.

Unless otherwise stated during checkout, recurring subscriptions automatically renew for successive billing periods until canceled.

When recurring billing is enabled, customers will be provided a clear disclosure substantially similar to:

"PoolStream Service — $XX/month. Renews automatically each month until canceled."

Cancellation prevents future renewals but does not ordinarily result in a prorated refund for a billing period already started, except where required by law or expressly provided by PoolStream.

PoolStream may offer trials, promotional pricing, grace periods, or other arrangements at its discretion.

5. Device Activation and Service Entitlement

PoolStream devices may require activation and association with a PoolStream account and venue before cloud-based functionality becomes available.

Each physical device has a unique device identity. PoolStream may use that identity to manage activation, licensing, subscriptions, security, software updates, and support.

A service subscription or entitlement may be associated with a particular device, customer account, or other PoolStream resource.

Replacement devices provided through an approved replacement or warranty process may be eligible to receive the service entitlement previously associated with the replaced device.

6. Internet and Network Requirements

PoolStream is an internet-connected product.

You are responsible for providing adequate internet access, local networking, Wi-Fi or Ethernet connectivity, firewall configuration, bandwidth, and other infrastructure required to operate the Services.

Streaming quality and availability may be affected by upload bandwidth, latency, packet loss, wireless interference, network congestion, internet-provider outages, and conditions outside PoolStream's control.

PoolStream does not guarantee uninterrupted streaming where the customer's network or third-party internet connectivity is unavailable or inadequate.

7. Streaming Platforms and Third-Party Services

PoolStream may integrate with third-party services such as YouTube and Facebook.

You are responsible for maintaining any third-party accounts required to use those services and for complying with their respective terms, policies, eligibility requirements, and content rules.

PoolStream cannot guarantee that a third-party provider will accept, publish, retain, monetize, or continue supporting a stream.

Third-party providers may modify or discontinue APIs, streaming protocols, account requirements, or features at any time.

PoolStream is not responsible for suspensions, strikes, demonetization, account termination, content removal, or other actions taken by a third-party platform.

8. Stream Keys and Credentials

Streaming keys, access tokens, passwords, and similar credentials should be treated as confidential.

You are responsible for credentials supplied to PoolStream for use with third-party services.

PoolStream may securely store encrypted credentials when necessary to provide configured Services.

You should immediately rotate any streaming key or credential that you believe has been disclosed or compromised.

9. Recording, Broadcasting, and Consent

You are responsible for determining whether you have the legal right to record, photograph, livestream, broadcast, or otherwise distribute audio, video, names, scores, likenesses, or other information involving individuals at your venue or event.

You are responsible for providing any notices and obtaining any permissions or consents required by applicable law.

PoolStream does not determine whether recording or broadcasting is lawful at a particular location or under particular circumstances.

By using PoolStream to record or broadcast content, you represent that you have the rights and permissions reasonably necessary to do so.

10. Customer Content

You retain your rights in content that you create or broadcast using PoolStream.

You grant PoolStream only the limited rights reasonably necessary to operate, maintain, secure, troubleshoot, and support the Services.

PoolStream does not claim ownership of your livestream video merely because PoolStream hardware or software was used to produce it.

11. Video Transmission

PoolStream is designed so that livestream video may be transmitted directly from the PoolStream appliance to the configured third-party streaming provider, such as YouTube or Facebook.

Under this architecture, livestream video does not ordinarily pass through or get stored by PoolStream Cloud.

PoolStream Cloud may process operational information necessary to manage the device and stream, such as device status, online status, streaming status, match information, scores, configuration, diagnostics, and command activity.

Future optional features involving cloud video processing or storage will be disclosed separately if introduced.

12. Software and Updates

PoolStream software is licensed, not sold.

PoolStream grants you a limited, non-exclusive, non-transferable license to use PoolStream software with authorized PoolStream hardware and Services.

PoolStream may provide software, firmware, configuration, security, and feature updates.

Certain updates may be installed automatically where reasonably necessary to maintain security, reliability, compatibility, or functionality.

You may not attempt to defeat licensing or entitlement controls, impersonate another PoolStream device, circumvent security measures, or use PoolStream software to gain unauthorized access to PoolStream systems.

13. Acceptable Use

You may not use PoolStream to violate applicable law; infringe intellectual-property or privacy rights; knowingly broadcast content you are not authorized to distribute; compromise or attempt to compromise PoolStream systems or other customers; distribute malware or malicious software; circumvent subscription, authentication, security, or device-identity controls; or interfere with the operation of the Services.

14. Availability and Maintenance

PoolStream will make commercially reasonable efforts to maintain reliable Services but does not guarantee uninterrupted or error-free operation.

Service may occasionally be unavailable because of maintenance, updates, equipment failure, internet outages, third-party outages, security events, or circumstances beyond PoolStream's reasonable control.

15. Suspension and Termination

PoolStream may suspend or restrict paid functionality when a subscription expires, is canceled, becomes delinquent, or otherwise loses its service entitlement.

PoolStream may also suspend or terminate access for material violations of these Terms, fraud, abuse, security threats, or unlawful activity.

Where practical, PoolStream may provide notice and an opportunity to correct an issue before terminating service.

Cancellation or termination of a subscription does not ordinarily transfer ownership of customer-purchased hardware back to PoolStream.

16. Warranty and Disclaimers

Any specific hardware warranty provided by PoolStream will be stated with the applicable hardware purchase or warranty documentation.

Except for express warranties provided by PoolStream and to the extent permitted by law, the Services are provided "as is" and "as available."

PoolStream does not warrant that every stream will be uninterrupted, that third-party platforms will always be available, or that the Services will satisfy every particular networking or broadcasting requirement.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

17. Limitation of Liability

To the maximum extent permitted by applicable law, PoolStream will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost recordings, or loss of data arising from use of or inability to use the Services.

To the maximum extent permitted by applicable law, PoolStream's aggregate liability arising from the Services will not exceed the amount paid to PoolStream for the affected Service during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold PoolStream harmless from third-party claims arising from content you record or broadcast, your violation of applicable law, your failure to obtain required recording or broadcasting permissions, or your material violation of these Terms.

19. Changes to the Services or Terms

PoolStream may modify the Services as the product evolves.

PoolStream may also update these Terms. When a material change is made, PoolStream may require you to review and accept a new version before continuing to use some or all of the Services.

Your acceptance of a new version may be recorded electronically, including the version accepted and the date and time of acceptance.

20. Governing Law

These Terms will be governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where applicable law requires otherwise.

The specific venue and dispute-resolution provisions may be supplemented or revised before commercial launch.

21. Contact

Questions regarding these Terms may be submitted through the contact methods published on the PoolStream website.
